GENERAL TERMS AND CONDITIONS

Unless expressly agreed otherwise, these General Terms and Conditions (GTC) apply to all transactions between Epic Snowsports GmbH and its customers. The object of the company is the operation of a snow sports school, bike school, online shop (epic-shop.ch/epicshop.ch), The Epic Shop Priva Alpine Lodge (Dieschen sot 18, 7078 Lenzerheide) & The Epic Shop Revier Mountain Lodge (Voa Principala 84, 7078 Lenzerheide )


Services include snow sports lessons and snow sports guiding, bike lessons and bike guiding, equipment hire, equipment maintenance and goods sales.

Capacity to act

The customer confirms that they are of legal age (i.e. 18 years or older) when the contract is concluded and, if they are acting as a body or representative, that they are duly authorised to conclude the contract. If he is not, he is liable for the consequences of the cancellation of the contract and for any resulting damage.


Letting
Collection and return of rental equipment
The customer can collect the hire equipment from 08:30 on the first day of hire. The hire equipment must be returned before 5.30 pm on the last day of hire. For each return after 5.30 p.m., the rental costs for an additional day will be charged.

Rentals after 16:00 (except bikes and sledges) will only be charged from the following calendar day. If the hire item (except bikes and sledges) is returned before 09:00 a.m., the current calendar day will not be charged.

If the hire items are not returned within 5 days of the end of the hire period and the hirer does not respond within this period, a charge of theft will be brought against him/her without further investigation.


Defects
The customer must check the rental item for defects immediately upon handover and on site. If the rental item already has defects, excluding slight signs of use, when it is handed over to the customer, the customer may cancel the rental if the hire shop is unable to rectify the defect or provide an equivalent replacement. Otherwise there are no warranty rights.

The customer must report any defects discovered later directly to the hire shop. If the customer fails to report the defect within 24 hours, he shall be liable for any damage incurred by the lessor as a result.

The Rental Firm must inspect the rental item for defects immediately and on site after the customer returns it. If the defect is not reported within 24 hours, the rental item shall be deemed to have been returned free of defects.


Liability
The rental equipment is generally not insured.

The customer is fully responsible for the rental item and must use it carefully and as intended in accordance with its function and conditions of use. The customer may not change the settings of the sports equipment made by the hire shop without authorisation.

The customer is responsible and liable for ensuring that the rental equipment is returned in a usable condition. The customer is not liable for defects and wear and tear that occur on the rental item due to its intended use. If the rented item shows defects that go beyond the consequences of the intended use or storage, the customer shall be liable for the repair costs and, where this is not possible, for the full sales price of the damaged equipment.

The customer must ensure that the equipment is handled in such a way that it is not accidentally misplaced, stolen or lost. In the event that the rental equipment is accidentally misplaced, stolen or lost, the customer will be charged the full retail price of the rental equipment.


Passing on the rental equipment
The customer may not pass on the sports equipment to third parties.


Delay in collection

In the event of a delay in collecting the rented equipment, the customer is obliged to inform the shop concerned as soon as possible. The reserved equipment will be retained by the shop for a maximum of 4 hours after the start of the first day of hire. After this time, the equipment will be released for hire again without the customer being entitled to any compensation.


Cancellation of the reservation
All reservations for rental equipment can be cancelled free of charge up to 17:30 the evening before. Cancellations must be made in person at the shop or in writing (info@epic-lenzerheide.ch).

We reserve the right to charge 100% of the amount for no-shows or late cancellations.


Early returns
The early return of rental objects is only accepted due to a violation and only if the rental object was returned as soon as possible. Early return due to bad weather will not be accepted.


Rental price
All prices are quoted in Swiss francs (CHF) and include all taxes applicable at the time of booking.


Snow sports and bike lessons/guiding

Booking/reservation of lessons
Both on-site and online bookings are considered confirmed bookings.


Cancellation of lessons
The cancellation of a customer’s lesson/guiding must be made in writing (info@epic-lenzerheide) at least 48 hours before the start of the course. Otherwise the full rate as per the booking will be charged.

A refund on our part will only be made if the cancellation is made in good time. There is no entitlement to a refund in the event of late arrival or premature cancellation of lessons.

In principle, the snow sports instructors/bike guides teach in all weathers. Epic Snowsports GmbH reserves the right to change, cancel or interrupt the programme, even during the activity, if natural and/or weather conditions or other unforeseen circumstances (force majeure, official and/or safety measures or other risks) make this necessary.

If lessons are cancelled for the above-mentioned reasons, a pro rata refund will be made.

In the event of accident/illness or other cases of hardship, the costs will be covered by the guest’s cancellation insurance, provided that this has been taken out in advance. Reimbursement is the responsibility of the participant. We recommend that all customers take out appropriate insurance.


Liability
Snow sports activities & mountain biking are dangerous sports. Epic Snowsports GmbH is not liable for accidents, injuries or death of guests. It is the responsibility of the guest or the responsible adult to decide whether the risk should be taken. Participants are responsible for taking out accident or liability insurance.

Epic Snowsports GmbH is not liable for damage or loss of equipment or personal belongings.


Prices
All prices are in Swiss francs (CHF).


(Online) Shop

Epic Snowsports GmbH operates a shop in the Priva Alpine Lodge in Lenzerheide, in the Hotel Revier Lenzerheide and an online shop (epic-shop.ch/epicshop.ch). In the context of the purchase contracts, Epic Snowsports GmbH is hereinafter referred to as the seller.


Conclusion of purchase contract
The product presentations in the online shop serve to submit an offer for the conclusion of a contract. By clicking on the button “order for a fee”, the customer submits a binding offer.

Confirmation of receipt of the order is sent by automated e-mail immediately after the order has been sent and does not yet constitute acceptance of the contract. The contract is concluded when the products are delivered.

In the physical shop, a sales contract is concluded as soon as payment is made.


Prices
All prices are quoted in Swiss francs (CHF) and include all taxes applicable at the time of booking.

The online discounts and/or discount codes shown cannot be combined with each other.


Delivery
Unless otherwise agreed, products are delivered from the warehouse to the shipping address specified by the customer.

If the ordered product is not available because the seller is not supplied with this product by its supplier through no fault of its own, or other obstacles such as force majeure and resulting bottlenecks in our supply chain arise, the seller may withdraw from the contract. In this case, the customer will be informed immediately. If the product cannot be delivered, the seller will immediately refund any payments already made.


Returns
If the customer wishes to cancel the purchase after having received the product, he may notify the seller within 14 days of receipt of the product and must submit the return within the same period (14 days of receipt of the product).

An item can only be returned if the product has no defects or damage and is returned in its original packaging with a delivery note. The postage for the return shipment shall be borne by the customer.

Items excluded from exchange are ex-rental products (such as winter sports equipment and mountain bikes), (ski) underwear, hygiene masks, food and reduced items.


Adjusting the ski binding
If ski bindings are adjusted, the following applies: Ski boots are adjusted to the ski binding if the customer’s ski boots are available. Only then do the binding settings comply with the safety requirements of the Swiss Council for Accident Prevention (ISO standard 11110). If your ski boot is defective or worn on the sole, this could result in different values.


Applicable law and place of jurisdiction

All obligations are subject to Swiss law. The exclusive place of jurisdiction is at the registered office of Epic Snowsports GmbH.


Severability clauses

Should one of the provisions of these GTC be or become illegal, invalid or unenforceable for any reason, this shall not affect the validity of the remaining provisions. Unless otherwise agreed, the invalid provision shall be deemed to be replaced by a valid provision that comes as close as possible to the economic purpose of the provision and the intention of the parties at the time the contract was concluded. The same applies to any loopholes in these GTC.
